In Florida, you may be charged with one of two crimes:
- Cultivation with the intent of personal use - this is the lesser of the two charges and is generally a misdemeanor (punishable by up to 12 months in county jail) because the cultivation was meant for personal use, not to sell or distribute to others.
- Cultivation with intent to distribute - this is a felony offense, punishable by a minimum of 1 year in state prison.
